Copyright and intellectual property in the field of art
Abstract
The article is dedicated to the theoretical and practical aspects of copyright and intellectual property protection in the field of art. Based on the analysis of scientific literature and legal acts, the peculiarities of legal protection of artistic works are highlighted and the mechanisms for safeguarding creative achievements are considered. Copyright is viewed as a fundamental component of the creative industries, guaranteeing artists – painters, musicians, and filmmakers – exclusive rights to their original works, ensuring the ability to control their use and to receive income from creative activity. The article analyzes educational, practical, and ethical aspects of integrating knowledge of intellectual property into the educational process, emphasizing the importance of legal awareness in the field of art in the digital age. It is noted that a modern artist acts not only as a creator but also as an active participant in legal, economic, and social processes. In this context, the concept of “intellectual property” goes beyond a purely legal category, becoming an instrument of creative freedom, personal security, and professional development. Special attention is paid to the challenges associated with the development of digital technologies, which lead to an increase in copyright infringements and determine the need for improving national and international legislation. At the same time, the role of international cooperation in the field of copyright protection is emphasized, since global cultural exchange requires common standards and transparent rules. Equally important is the formation of legal culture skills among future artists, which ensures their competitiveness in the global market. The development of legal literacy in creative communities contributes not only to the protection of copyright but also to creating conditions for innovation and sustainable growth of the creative industries. In conclusion, it is stressed that the harmonious combination of art and legal awareness is the key to the successful integration of Ukrainian artists into the global cultural space.
